1) INTERPRETATION
a) “Associated Notices & Policies” means those notices and policies listed under clause 2(c). b) “Intellectual Property” means all works, trademarks, trademark applications, patents, patent applications, copyright materials, trade names, trade name applications, industrial designs, and applications to register designs; c) “Platform” means the UCC Alumni Online Platform; d) “Platform Administrators” means the UCC Alumni and Development Office who is responsible for core administration, implementation, development and support of the Platform; e) “Services” means those services more specifically detailed in clause 3)b); f) “User” means a User of the Platform; g) “User Content” means material and information which You contribute to the Platform and to User Generated Content services and includes (but is not limited to), messages, notices and posts; h) “we/us/our” means University College Cork; i) “you” means Platform applicant and/or User;
2) ELIGIBILITY & REGISTRATION
a) Eligibility: Application for admission to the Platform is available to all graduates of University College Cork subject to the completion of the registration process prescribed in clause 1)b hereunder. b) Application: To apply for admission to the Platform you are required to complete and submit a completed Registration Form. In submitting the Registration Form together with any documentary verification of identity you warrant that all data provided by you therein is accurate. On successful application, Users will be permitted access to the Platform by logging in using the Username and password provided by Platform Administrators. c) Acceptance of Terms: By logging into the Platform you confirm your acceptance of these terms and conditions together with the following associated notices and policies hereby incorporated;
i) UCC Privacy Notice, which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using the Platform, you consent to such processing and you warrant that all data provided by you is accurate. ii) UCC Cookies Policy, which sets out information about the cookies on the Platform. iii) UCC Acceptable Use Policy which provides clear guidance on the acceptable, safe and legal way in the use of UCC’s IT and Network Resources iv) The Alumni and Supporters Data Protection Notice which provides clear guidance on how your personal data is processed.
d) Compliance: You agree to comply with these terms and conditions together with associated notices and policies. Where you do not agree with these terms and conditions together with Associated Notices & Policies, you must not use the Platform. e) Password: You are responsible for maintaining the confidentiality of any password(s) you are given to access the Platform, and are fully responsible for all activities that occur under your password(s). You agree to notify the Platform Administrators immediately of any unauthorized use of your password(s).
3) PLATFORM SERVICES
a) Access to the Platform and the services available thereon is provided “as is” and on an “as available” basis. We may alter, suspend or discontinue The Platform (or any part of it) at any time and without notice. We will not be liable to you in any way if the Platform (or any part of it) is unavailable at any time and for any period. b) A non-exhaustive list of the services available to Users is listed below;

User Interactive Services o Event Registration o Alumni Profile and Directory
Donations o Single payments (on-off) donations o Recurring donations
4) PLATFORM ADMINISTRATOR SERVICES
a) The content on the Platform is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Platform. b) Although we make reasonable efforts to update the information on the Platform, we make no representations, warranties or guarantees, whether express or implied, that the content on the Platform is accurate, complete or up to date. c) We are the owner or the licensee of all intellectual Property rights on the Platform save and except any Intellectual Property comprised in any User Content. All such rights are reserved. d) You may print off one copy, and may download extracts, of any page(s) from the Platform for your personal use only. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. e) If you print off, copy or download any part of the Platform in breach of these terms of use, your right to use the Platform will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. f) Our status (and that of any identified contributors) as the authors of content on the Platform must always be acknowledged. g) You must not use any part of the content on the Platform for commercial purposes without obtaining a licence to do so from us or our licensors. h) We reserve the right to retract alumni benefits as outlined on the Platform at any time and at our sole discretion.
5) USER GENERATED CONTENT
a) The Platform may include information and materials uploaded by other Users of the Platform to messaging services, notice boards and posts. We have no responsibility for verification of information and materials uploaded by Users of the Platform. The views expressed by Users on the Platform do not represent our views or values. b) UCC and the Platform Administrators are not responsible for monitoring or moderating any User Generated Content contributed to the Platform, and we expressly exclude liability for any loss or damage arising from the use of any User Generated Content in contravention of our content standards, whether the service is moderated or not. c) Content standards apply to any and all User Content. Content Standards must be complied with. The standards apply to each part of User Content contributed as well as to its whole. The Platform Administrators will determine, in their discretion, whether a User Content breaches the Content Standards.
A non-exhaustive list of Content Standard is listed as follows;
User Content must:
i) Be accurate (where it states facts). ii) Be genuinely held (where it states opinions). iii) Comply with the law applicable in Rep of Ireland and in any country from which it is posted.
User Content must not:
iv) Be defamatory of any person. v) Be obscene, offensive, hateful or inflammatory. vi) Bully, insult, intimidate or humiliate. vii) Promote sexually explicit material. viii) Promote violence. ix) Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age. x) Infringe any copyright, trademark or any intellectual property rights of any other person. xi) Be likely to deceive any person. xii) Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence. xiii) Promote any illegal activity. xiv) Be in contempt of court. xv) Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety. xvi) Be likely to harass, upset, embarrass, alarm or annoy any other person. xvii) Impersonate any person, or misrepresent your identity or affiliation with any person. xviii) Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse. xix) Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism. xx) advertise or promote any services or web links to other sites without expressly stating that such advertisement or promotion is not endorsed (expressly or impliedly) by UCC or the UCC Alumni and Development Office.
d) Intellectual Property comprised in User Content on the Platform and the copyright and other intellectual property rights subsisting in that User Content, unless specifically labelled otherwise, belongs to or has been licensed by the User identified along with that User Content. Users may not otherwise copy, distribute, publicly perform, publicly display, reproduce, or create derivative works based upon other User Content, without first obtaining the express written permission of the User to whom the User Content in question belongs.
6) USER INTERACTIVE SERVICES:
a) Events: Where a User registers for and/or attends an event, the User agrees to be bound by, and comply with such terms and conditions as may be further prescribed for that event and it is the User's responsibility to read and understand such terms and conditions. b) Event Payment: Payment of event fee to the University is facilitated by Stripe, a third party service provider and pursuant to the following terms.

c) Event Cancellation: UCC reserves the right to cancel an event due to low enrolment or other circumstances which would make the event non-viable. If an event is cancelled, all registrants will be offered a full refund of their purchased ticket(s). If an event is postponed, registrants will have the option to either receive a full refund or transfer registration. d) Refunds: In order to receive a full refund for a paid event, Administrator must receive notice at least five working days before the event. Please email alumni@ucc.ie to request a refund. Special circumstances will be taken into consideration.
7) DONATIONS
a) Users can make donations to the University by completing the Online Donation Form hosted on the Platform. b) Where User confirms a donation to the University, to include the amount and selected charitable objective, the transaction will be processed by Stripe, a third party service provider and pursuant to the following terms.
i) For payments made in Ireland: https://stripe.com/ie/ssa ii) For payments made in the UK: https://stripe.com/gb/legal iii) For payments made in the US: https://stripe.com/legal By confirming an intention to proceed when prompted, the User authorises Stripe to request funds from the Users credit/ debit card, or PayPal account.
c) By completing the online donation form, you agree that you have obtained the necessary authority, should authorisation be required, to make an online donation. The University reserves the right to decline or return donations at its sole discretion d) Donations will be applied at UCC’s discretion but within the charitable objective selected by the User in the Online Donation Form. e) Donations are non-refundable and cannot be cancelled or returned once processed. If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider in accordance with its reporting rules.
8) COMMUNICATION
a) You agree that we may communicate with you through your User account or through other means including email, mobile and telephone about your account, registration or services associated with the Platform. Please review your profile to control and select the type of messages or communications you wish to receive from us. b) Alternatively to unsubscribe from any communication received from us, please click on the unsubscribe mechanism at the bottom of the communication. You acknowledge and agree that we shall have no liability associated with or arising from your failure to do so.
9) BREACH
a) If we determine in our sole discretion that a particular User conduct violates applicable law, is harmful to our interests or is in breach of these Terms and Conditions and Associated Notices & Policies we reserve the right to
i) Immediately, temporarily or permanently withdraw your right to use or access the Platform. ii) Immediately, temporarily or permanently remove any User Content uploaded by you to the Platform. iii) Impose limits on certain features of the Platform and the Services or restrict your access to parts or all of the Services without notice or liability. iv) Disclose such information to law enforcement authorities as we reasonably feel is necessary or as required by law.
b) We exclude our liability for all action we may take in response to breaches of this acceptable use policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.
10) GENERAL
a) We may update and change the Platform from time to time to reflect changes to our services, User needs and our business priorities. Reasonable notice of any major changes will be provided on a case by case basis. b) We do not guarantee that the Platform, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of the Platform for business and operational reasons. Reasonable notice of any suspension or withdrawal will be provided on a case by case basis. c) The Platform Administrators may amend these terms from time to time. Every time you wish to use the Platform please check these terms to ensure you understand the terms that apply at that time. d) Advertisements, promotions and links to other third party sites may be included on the Platform from time to time. Unless expressly stated, these sites are not under our control. We neither assume nor accept responsibility or liability for the content of third party sites. The inclusion of an advertisement, promotion link to other third party sites on the Platform is for information only and does not imply any UCC endorsement of advertisement, promotion or third party site or of those in control of them. e) All Personal Data shared by you or collected by us shall only be processed for the purpose of providing the Services. All Personal Data shall be processed in line with UCC’s Privacy Notice and Data Protection Policy. f) For any queries or complaints, to include complaints with regard to the conduct of other Users in their use of the Platform please contact dewg@ucc.ie. g) We do not guarantee that the Platform will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes to access the Platform. We recommend you use your own virus protection software. h) You must not misuse the Platform by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Platform, the server on which the Platform is stored or any server, computer or database connected to the Platform. You must not attack the Platform via a denial-of-service attack or a distributed denial-of service attack.
